These Terms of Use (“Terms”) govern your use of https://www.miamicarcollective.com (the “Site”), operated by Miami Car Collective LLC (“Miami Car Collective”, “we”, “us”). By using the Site or contacting us by phone or text you agree to these Terms. If you do not agree, please do not use the Site.

The Site is for information, not bookings

The Site describes our vehicles and services. All inquiries and bookings are handled by phone or text message. Calling or texting us does not by itself create a reservation. A rental is confirmed only when we have accepted your request, you have signed our rental agreement, and any required deposit has been received.

Quotes and pricing

Rates vary with the season, day of the week, rental length, delivery distance and vehicle. Any rate we quote by phone or text is valid only for the dates and vehicle quoted and may change until the rental is confirmed. Security deposits, mileage allowances, delivery fees, fuel, tolls, taxes and any applicable surcharges are explained before you commit and are set out in the rental agreement.

Rental agreement governs the rental

Every rental is governed by a separate written rental agreement, which covers driver eligibility, insurance, deposit, mileage, fuel, tolls, fines, damage, prohibited uses, cancellation and all other rental terms. If anything on the Site conflicts with the rental agreement, the rental agreement controls.

Eligibility

Renters must be at least 25 years old and hold a valid driver’s license, a major credit card in the renter’s name, and full-coverage automobile insurance that extends to rental vehicles. We may verify these requirements and may decline any rental at our discretion. Additional drivers must be approved in advance.

Availability and vehicle substitutions

Vehicle availability changes daily. Photos and specifications on the Site are accurate to the best of our knowledge, but colors, options and details may vary. If a reserved vehicle becomes unavailable for reasons beyond our control, we will offer a comparable vehicle or a full refund of any amounts paid.

Acceptable use of the Site

• Do not make false, misleading or fraudulent inquiries.
• Do not attempt to interfere with the Site, probe its security, or scrape its content.
• Do not use the Site for any unlawful purpose.

Communications

By calling or texting us you agree that we may call or text you back about your inquiry or rental. Message and data rates may apply. Reply STOP to opt out of texts. See our Privacy Policy for details on how we handle your information.

Intellectual property

The Site’s text, photographs, videos, logos and design are owned by or licensed to Miami Car Collective and are protected by copyright and trademark law. You may view and share links to the Site, but you may not copy, reproduce or use its content for commercial purposes without our written permission. Lamborghini, Chevrolet, Corvette and other vehicle names are trademarks of their respective manufacturers, which are not affiliated with us.

Disclaimers

The Site is provided “as is” and “as available.” We do not warrant that it will be error-free or uninterrupted, or that information on it is complete or current. To the fullest extent permitted by law we disclaim all warranties, express or implied, regarding the Site.

Limitation of liability

To the fullest extent permitted by law, Miami Car Collective is not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or reliance on its content. Liability arising from a rental is governed exclusively by the rental agreement.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Miami-Dade County, Florida.

Changes

We may update these Terms at any time by posting a revised version on the Site. The date at the top shows the latest revision. Your continued use of the Site after a change means you accept the revised Terms.
